zing bars affiliate program terms & conditions

program overview

the zing bars affiliate program allows approved affiliates, influencers, creators, and brand advocates to promote zing bars products, earn commissions on qualifying sales, and collaborate with zing bars through authentic content creation and brand partnerships.

by applying to and participating in the zing bars affiliate program, you agree to the following terms and conditions.

eligibility

to participate in the program, applicants must:

• be at least 18 years of age.
• provide accurate application information.
• maintain active social media accounts or other approved promotional channels.
• comply with all applicable laws, regulations, and platform policies.
  

zing bars reserves the right to approve, deny, or remove any participant from the program at its sole discretion.

commissions

approved affiliates may earn commissions on qualifying one-time purchases attributed through their unique affiliate links or discount codes. subscription purchases, including initial subscription orders and recurring subscription renewals, are not eligible for affiliate commissions.

customers are not permanently assigned to an affiliate based on a previous purchase or interaction. subsequent one-time purchases may also qualify for commission when attributed to the affiliate through their link or discount code in accordance with shopify collabs tracking.

commission rates, promotional offers, and program benefits may be modified by zing bars at any time.

commissions will be tracked and paid through shopify collabs or another approved affiliate platform in accordance with that platform's payment schedule and policies. commissions are earned only on completed, qualifying purchases. canceled orders, refunded purchases, chargebacks, fraudulent transactions, or other invalid sales are not eligible for commission.

fraudulent, deceptive, or self-generated purchases may result in commission forfeiture and removal from the program.

disclosure requirements

affiliates must clearly disclose their relationship with zing bars whenever promoting zing bars products, including when receiving complimentary products, earning commissions, or participating in sponsored collaborations.

acceptable disclosures may include:

- "ad" or "#ad"
- "i earn a commission when you shop through my link."
- "zing bars gifted me these products."
- "this post contains affiliate links, and i may earn a commission if you make a purchase."

disclosures must be clear, visible, and easily understood by consumers. they should be placed prominently within the content, rather than hidden among hashtags, buried in captions, or accessible only through a link.

affiliates are responsible for complying with all applicable federal trade commission (ftc) endorsement guidelines, platform disclosure requirements, and other applicable advertising regulations.

content guidelines

affiliates may not:

• make false or misleading claims about zing bars products.
• make medical, disease treatment, prevention, or cure claims.
• make weight-loss claims.
• misrepresent their relationship with zing bars.
• engage in deceptive marketing practices.
  

zing bars reserves the right to request edits to or removal of content that does not comply with these guidelines.

content ownership + usage

affiliates retain ownership of the original content they create.

by participating in the zing bars affiliate program, affiliates grant zing bars a non-exclusive, royalty-free license to repost and share publicly available content featuring zing bars products on zing bars-owned organic social media channels, with creator credit where reasonably possible.

use of affiliate content in paid advertising, email marketing, website content, retail materials, or other paid or promotional materials requires separate permission from the affiliate unless otherwise agreed in writing.

this permission applies while the affiliate participates in the zing bars affiliate program. zing bars may retain previously published organic social posts after the affiliate relationship ends unless the affiliate requests removal.

prohibited activities

affiliates may not:

• purchase products through their own affiliate links or discount codes for the purpose of earning commissions.
• post affiliate codes or links on coupon, cashback, or deal websites without written approval.
• bid on zing bars trademarks or impersonate the zing bars brand in paid search advertising without written permission.
• create fake referrals, fraudulent accounts, or misleading promotions.
• engage in spam or other deceptive marketing practices.
  

intellectual property

all zing bars trademarks, logos, product names, packaging, images, and other brand assets remain the exclusive property of zing bars.

affiliates may use approved zing bars brand assets solely for the purpose of promoting zing bars while participating in the affiliate program. brand assets may not be modified, misrepresented, or used in a manner that could damage or misrepresent the zing bars brand.

product samples

from time to time, zing bars may provide complimentary products to affiliates for review, content creation, or promotional purposes.

complimentary products are provided as a gift and do not guarantee compensation beyond the affiliate commission structure or require the affiliate to publish a specific number of posts unless separately agreed upon.

termination

participation in the program is voluntary.

either the affiliate or zing bars may terminate participation in the program at any time and for any reason.

upon termination, affiliates must discontinue use of zing bars affiliate links, discount codes, and brand assets as directed by zing bars.

zing bars reserves the right to withhold or reverse unpaid commissions related to fraudulent, deceptive, invalid, or non-compliant activity, subject to applicable platform policies and law.

limitation of liability

to the fullest extent permitted by applicable law, zing bars shall not be liable for any indirect, incidental, special, or consequential damages arising from participation in the affiliate program.

governing law

these terms and conditions shall be governed by and interpreted in accordance with the laws of the state of washington, without regard to its conflict of law principles.

modifications

zing bars reserves the right to update or modify these terms and conditions from time to time. affiliates will be notified of material changes when appropriate. continued participation in the program following the effective date of updated terms constitutes acceptance of the revised terms.

these terms and conditions supplement the zing bars website terms of service. in the event of any conflict relating specifically to participation in the zing bars affiliate program, these affiliate program terms and conditions will govern.
